Terms of Use
These terms govern your Noma account, travel content, trip-planning tools, and Noma Pro subscription. Please read them before using the service.
1. Agreement and eligibility
These Terms of Use (“Terms”) form a binding agreement between you and Noma for the Noma mobile applications, websites, support channels, and related services (the “Service”). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
You must be able to enter a legally binding contract where you live. If you are below the age of legal majority, a parent or guardian must review and accept these Terms and supervise your use. You may use Noma only where the Service is lawfully available to you.
2. What Noma provides
Noma is consumer software for recording places, organising travel memories and documents, discovering places, and planning trips. Noma may surface third-party travel information, links, availability, or prices, but Noma is not an airline, hotel, tour operator, travel agency, insurer, payment card issuer, or government authority. Unless a checkout expressly says otherwise, Noma does not sell, reserve, fulfil, or guarantee travel services.
3. Accounts and security
Provide accurate information, keep your sign-in method secure, and promptly update details that change. You are responsible for activity under your account unless caused by our breach of duty. Do not share credentials or bypass account, subscription, or security controls. Notify hello@nomatravel.xyz promptly if you suspect unauthorised access. We may require identity or account verification before changing access, disclosing data, or acting on a sensitive request.
4. Travel information and your responsibility
You are responsible for checking names, dates, times, prices, availability, booking status, entry and visa rules, health and safety requirements, insurance, accessibility, local laws, and cancellation terms directly with the relevant provider or authority. Maps, directions, weather, opening hours, fares, hotel information, and other travel data can change without notice. Do not rely on Noma for emergencies or as your only copy of a ticket, visa, identity document, booking confirmation, or critical itinerary.
5. AI-assisted features
AI-generated plans, summaries, extracted fields, recommendations, and chat responses may be incomplete, outdated, biased, or wrong. They are suggestions, not professional, legal, medical, immigration, financial, safety, or travel-agent advice. Review outputs and confirm consequential decisions with original documents and qualified or official sources. You remain responsible for prompts you submit and actions you take based on an output.
6. Your content
You retain ownership of trips, notes, photos, documents, prompts, and other content you submit (“Your Content”). You grant Noma a worldwide, non-exclusive, royalty-free licence to host, copy, process, adapt, transmit, display, and create technical derivatives of Your Content only as reasonably necessary to provide, personalise, secure, support, and improve the Service and to comply with law. This licence ends when the content is deleted, subject to sharing already initiated, routine backup cycles, and lawful retention.
You represent that you have the rights and permissions needed to submit Your Content and that doing so will not violate another person's intellectual-property, privacy, publicity, confidentiality, or other rights. If content includes another traveller's personal data, you are responsible for giving appropriate notice and obtaining any required permission.
7. Shared trips and links
If you invite someone or create a share link, recipients may view, copy, or act on the content made available through that feature. You control whom you invite and must review sensitive details before sharing. Revoking a link stops future access through Noma where supported, but it cannot retrieve copies already made outside the Service. Collaborators are responsible for their own activity and content.
8. Acceptable use
You must not use Noma to:
- break applicable law, facilitate harm, fraud, harassment, exploitation, trafficking, or unauthorised surveillance;
- upload malware, stolen documents, unlawful content, or content that infringes another person's rights;
- access another account or scrape, probe, overload, disrupt, reverse engineer, or circumvent the Service or its security except where law expressly permits;
- resell, sublicense, or commercially exploit Noma or automated outputs without written permission; or
- misrepresent Noma output as verified official information or use the Service to make fully automated high-impact decisions about another person.
We may investigate suspected misuse and remove content, limit a feature, or suspend access when reasonably necessary to protect users, Noma, third parties, or the integrity of the Service.
9. Third-party services
Noma relies on or links to services such as app stores, authentication providers, maps, place and travel-data sources, payment processors, AI providers, image providers, and booking sites. Their own terms, privacy notices, prices, eligibility rules, and cancellation policies apply to your relationship with them. Noma is not responsible for a third party's content, acts, outages, changes, transactions, or fulfilment. A link or integration is not an endorsement or guarantee.
Noma includes Google Maps features and content. Your use of those features is subject to the Google Maps/Google Earth Additional Terms and the Google Privacy Policy.
10. Noma Pro, pricing, and billing
Paid plans, billing periods, included features, trial terms, renewal price, taxes, and currency are shown before purchase. Subscriptions automatically renew for the same period until cancelled, unless the checkout states otherwise. Your payment provider may charge the saved payment method on or shortly before the renewal date. Prices may change prospectively with notice and any consent required by law; you can cancel before the new price takes effect.
Purchases made through Apple's App Store or Google Play are billed and administered by that store. A web checkout may be sold and billed by Paddle as merchant of record. RevenueCat may synchronise entitlement status across supported platforms. Taxes and payment terms presented by the seller of record form part of your purchase.
For web subscriptions offered through Paddle: “Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns”. In this sentence, “all our orders” means orders presented through that Paddle checkout, not App Store or Google Play purchases.
11. Trials, cancellation, and refunds
If a trial converts to a paid subscription, cancel before the deadline shown at checkout to avoid the first charge. Cancelling stops future renewals but normally leaves access active until the end of the paid period. Deleting the Noma app or your account does not automatically cancel a subscription managed by a store or payment provider.
Refund eligibility and request instructions depend on where you purchased and the law where you live. The separate Refund Policy at nomatravel.xyz/refunds is incorporated into these Terms. Nothing in these Terms limits non-waivable consumer rights.
12. Noma intellectual property
The Service, software, design, brand, artwork, databases, and Noma content are owned by or licensed to Noma and protected by applicable law. Subject to these Terms, Noma grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended consumer purpose. No other rights are granted. Third-party names, maps, photos, and data remain the property of their respective owners.
13. Feedback
If you voluntarily send ideas or feedback, you grant Noma a perpetual, worldwide, royalty-free right to use it without restriction or compensation, provided this does not transfer ownership of Your Content or override the Privacy Policy.
14. Changes, availability, and beta features
We may add, change, suspend, or discontinue features to improve the Service, address security or legal requirements, or reflect third-party changes. We will provide notice when required and avoid materially reducing a prepaid core benefit without an appropriate remedy. Beta or preview features may be incomplete, change rapidly, and have additional limits disclosed when offered.
15. Suspension and termination
You may stop using Noma and delete your account at any time. We may suspend or terminate access if you materially or repeatedly breach these Terms, create legal or security risk, fail to pay, or use the Service fraudulently or unlawfully. Where appropriate, we will give notice and a reasonable opportunity to fix the issue. We may act immediately when delay could cause harm, compromise an investigation, or violate law. Provisions that by their nature should survive will survive termination.
16. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Noma disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, and freedom from harmful components. We do not warrant that content will never be lost, that an itinerary will be feasible, or that a third party will honour any listing, fare, booking, or recommendation. These exclusions do not apply where prohibited by mandatory law.
17. Limitation of liability
Nothing excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, or personal injury caused by negligence where applicable. To the fullest extent permitted by law, Noma is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, opportunities, goodwill, data, or travel; missed bookings or connections; or third-party acts, even if advised they were possible. Noma's aggregate liability arising from the Service will not exceed the greater of the amount you paid Noma for the Service in the twelve months before the event or USD 50. Mandatory consumer rights and remedies remain unaffected.
18. Indemnity for misuse
To the extent permitted by law, you will defend and indemnify Noma against third-party claims, losses, and reasonable costs caused by Your Content, your unlawful or unauthorised use, or your material breach of these Terms. This does not require you to indemnify Noma for Noma's own negligence, wilful misconduct, or breach of law.
19. App-store terms
If you downloaded Noma from Apple, these Terms are between you and Noma, not Apple. Apple is not responsible for Noma, maintenance, support, or claims relating to the app, except for obligations it cannot exclude and any refund Apple provides under its rules. Your licence is limited to Apple-branded products you own or control as permitted by the App Store Usage Rules. Apple's Standard EULA also applies unless Noma publishes a custom App Store EULA. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it. Equivalent store rules apply when Noma is obtained elsewhere.
20. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Before filing a claim, contact hello@nomatravel.xyz and give us 30 days to try to resolve it informally. If it is not resolved, either party may bring proceedings before a court with competent jurisdiction under applicable law. If you are a consumer, you retain any mandatory rights and may bring a claim or complaint in any forum that consumer law makes available to you.
21. Changes to these Terms
We may update these Terms to reflect Service, provider, legal, or security changes. We will post the revised Terms with a new effective date and provide additional notice when a change is material. If law requires consent, the change will not apply until consent is obtained. Continued use after an effective update means acceptance where law permits; otherwise you may stop using the Service.
22. General terms and contact
These Terms, the Privacy Policy, the Refund Policy, and terms shown at purchase are the entire agreement about the Service. If one provision is unenforceable, it will be limited as necessary and the rest remain effective. A delay in enforcement is not a waiver. You may not assign these Terms without consent; Noma may assign them as part of a lawful reorganisation or transfer of the Service with appropriate notice. Section headings are for convenience. Electronic notices satisfy written-notice requirements where law allows.
